1. Agreement to Terms

By accessing or using Commands.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Commands.com provides a secure relay service ("Gateway") that allows users to:

• Run AI agents locally on their machines and share access with remote users through an encrypted relay
• Chat with shared AI agents from a browser without installing any software
• Configure agent permissions and monitor sessions in real time
• Communicate through end-to-end encrypted channels that Commands.com cannot decrypt

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to use this Service
• One person or legal entity may maintain no more than one account

3.2 Account Responsibilities

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. User Content

4.1 Your Content

Content transmitted through the Gateway relay remains yours:

• You retain full ownership of all code, data, and content on your local machine
• Commands.com does not store, access, or process the content of encrypted relay sessions
• You are responsible for the content your agent makes available through the relay
• You represent that you have the right to share any content accessible through your agent

4.2 Content Guidelines

You agree not to submit content that:

• Infringes any intellectual property rights
• Contains malicious code, malware, or harmful scripts
• Is illegal, threatening, abusive, harassing, or defamatory
• Contains personal information of others without consent
• Violates any applicable laws or regulations
• Is spam or misleading
• Could damage or interfere with the Service

4.3 Content Moderation

• We reserve the right to remove any content that violates these Terms
• We may review content before or after it is posted
• We are not responsible for user-generated content

5. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal purposes
• Upload or distribute malware, viruses, or malicious code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Reverse engineer or attempt to extract the source code of the Service
• Use automated means to access the Service without permission
• Impersonate another person or entity
• Collect or harvest user data without permission
• Use the Service to distribute spam

6. Intellectual Property

6.1 Service Content

The Service and its original content (excluding user content) are owned by Commands.com and are protected by copyright, trademark, and other laws.

6.2 User Content

Content transmitted through the Gateway relay is not stored by Commands.com and remains subject to your own licensing and intellectual property rights. We do not claim any rights over content relayed through the Service.

6.3 Copyright Policy

We respect intellectual property rights. If you believe any content infringes your copyright, please contact us with:

• Identification of the copyrighted work
• Identification of the infringing material
• Your contact information
• A statement of good faith belief
• A statement of accuracy and authorization

7. Gateway Relay Service

7.1 Relay Operation

• Commands.com acts solely as an encrypted relay between local agents and remote users
• We do not decrypt, inspect, store, or process the content of relay sessions
• We verify agent identity through cryptographic signatures but cannot read session data
• Session encryption keys are derived independently by each endpoint and never transmitted to our servers

7.2 Agent Permissions and Responsibility

• You are responsible for configuring appropriate permission profiles on your local agent
• You are responsible for monitoring sessions and revoking access when appropriate
• Commands.com is not liable for actions taken by agents on your local machine
• You should only grant access to individuals you trust at the permission level you configure

8. Privacy and Data Protection

8.1 Data Collection

We collect and process data as described in our Privacy Policy, including:

• Account information (email, display name)
• Content you submit
• Usage data and analytics
• Authentication tokens

8.2 Data Security

• We implement reasonable security measures to protect your data
• You acknowledge that no internet transmission is completely secure
• You are responsible for maintaining the confidentiality of your account

9. Subscriptions and Payment Terms

9.1 Payment Processing

• Subscription payments are processed through Stripe
• You must comply with Stripe's terms of service and acceptable use policies
• We do not store your payment information on our servers
• Payment disputes are handled through Stripe's dispute resolution process

9.2 Subscription Terms

• Gateway access may require a paid subscription depending on usage tier
• Subscriptions renew automatically unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period

9.3 Refunds

• Refund requests must be made within 7 days of payment
• Refunds are at the sole discretion of Commands.com
• We may issue refunds in cases of technical errors or service failures

10. Third-Party Services

10.1 Authentication

We use Firebase Authentication for user authentication. By using our Service, you also agree to Firebase's terms of service.

10.2 Content Delivery

We use AWS services (S3, CloudFront) for content storage and delivery. Your uploaded content is subject to AWS's terms of service.

10.3 Payment Processing

We use Stripe for payment processing. By making purchases or connecting a creator account, you agree to Stripe's terms of service and privacy policy.

11. Disclaimers and Limitations of Liability

11.1 Service Availability

• The Service is provided "as is" and "as available"
• We do not guarantee uninterrupted or error-free operation
• We may modify or discontinue the Service at any time

11.2 Content Disclaimer

• We do not endorse or guarantee the accuracy of user-generated content
• You use commands and prompts at your own risk
• We are not responsible for any damage caused by user content

11.3 Limitation of Liability

To the maximum extent permitted by law, Commands.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Commands.com, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the new Terms on the Service
• Updating the "Last Updated" date
• Sending notice to registered users (at our discretion)

Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us.

14.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Illegal activities
• Harmful behavior toward other users or the Service
• Extended periods of inactivity

14.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and content
• Content you've shared may remain available to other users
• All provisions of these Terms that should survive termination will remain in effect

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of New York, NY, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

1. Good faith negotiations
2. Mediation (if negotiations fail)
3. Binding arbitration (if mediation fails)

15.3 Exceptions

You may pursue claims in small claims court if eligible. Either party may seek injunctive relief in court for intellectual property violations.

16. General Provisions

16.1 Entire Agreement

These Terms constitute the entire agreement between you and Commands.com regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

18. Additional Terms for Gateway Features

18.1 End-to-End Encryption

• Session encryption keys are generated and stored only on endpoint devices
• Commands.com cannot decrypt relay traffic and is not responsible for the content of encrypted sessions
• You acknowledge that the security of your sessions depends on the security of your local device
• Compromise of your device may compromise your session keys

18.2 Local Agent Execution

• The local agent executes actions on your machine based on remote user requests
• You are responsible for configuring appropriate permission profiles to limit agent capabilities
• Commands.com is not liable for any actions taken by the agent on your system
• We strongly recommend using read-only or dev-safe profiles when sharing with untrusted users
